Welcome to the MN Fundraising Initiative (“MNFI,” “we,” “our,” “us”) home page.   We are a section 501(c)(3) not-for-profit corporation that enriches the lives of Minnesota adults and youth by providing grants to fund educational and sports opportunities they would not otherwise be able to experience.

Our home page at Home – (mnfundraisinginitiative.org) and all other webpages controlled by us (the “Site(s)”) are subject to these terms and conditions (“Terms”).   These Terms describe the rules for using the Sites, including all subsidiary webpages, and are legally binding between you, the person using the Sites, and us.

We reserve the right to withdraw or amend the Sites, and any service or material we provide on the Sites, in our sole and absolute discretion without any notice to you.   We are not liable if for any reason the Sites or any portion or part of the Sites are unavailable to you at any time.

Though we make reasonable efforts to keep the information available on the Website current and accurate, errors can and do occur. We provide the information on the Website with no representations or guarantees of accuracy, completeness, or timeliness (up to date). Any of the Sites’ content may be incorrect or not up to date at any given time, and MNFI is not obligated to correct or update such material.

Indemnification and Limitation of Liability

You agree to indemnify and hold harmless each of us, our affiliates, officers, directors, employees, agents, volunteers, third party providers of Site contents or services (“Parties”) from any claim or demand, including reasonable attorneys’ fees, made by any third party due to, arising out of, or related to your use of this Website, the violation of these Terms by you, or the infringement by you of any intellectual property or other right of any person or entity.  This includes any claim, demand, or damages, including reasonable attorneys’ fees, from your breach of the Terms or your use or misuse of our Sites or any content thereon.  

UNLESS PROHIBITED BY APPLICABLE LAW, YOU AGREE THAT NONE OF THE PARTIES WILL BE LIABLE FOR ANY DAMAGES OR INJURIES RESULTING FROM YOUR USE OR LACK OF ABILITY TO USE THE SITES, OR THE SERVICES, PRODUCTS OR CONTENT ON THE SITES. THIS INCLUDES, BUT IS NOT LIMITED TO, ERRORS, OMISSIONS, INTERRUPTIONS, COMPUTER VIRUSES, OR INFORMATION THEFT.  IN ANY EVENT, THE TOTAL CUMULATIVE LIABLITY OF THE PARTIES, FOR DAMAGES OR INJURIES SHALL BE LIMITED TO ACTUAL DAMAGES, NOT EXCEEDING THE GREATER OF $1.00 OR THE AMOUNT YOU PAID TO US.    THIS COVERS CLAIMS BASED ON ANY LEGAL THEORY.

General Provisions

The Terms and Privacy Policy are the sole and complete agreement between you and us with respect to the Sites and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral with respect to the Sites or your use of the Sites.   If any provision of these Terms is determined to be invalid under any applicable statute or rule of law, such provision is to that extent to be deemed omitted, and the balance of the Terms shall remain enforceable. 

You agree to notify us in writing and provide us 30 days to cure any harm before initiating any action against has related to any harm you believe you have suffered from your use of the Sites.   If we do not immediately take action to address a violation of these Terms, we are not waiving our rights to take action in the future. If any particular provision of these Terms is found to be unenforceable, that provision will be severable and will not affect any of the other provisions.

This Website is owned and operated by us from our offices in the state of Minnesota in the United States. The Sites are only for use by persons located in the United States.   The content or Sites may not be accessible or appropriate outside of the United States and we make no claims that the content or Sites are accessible or appropriate outside of the United States.  

Your use of the Website, and any related legal action, will be governed by the laws of the State of Minnesota, without regard to conflict of laws principles. The sole jurisdiction for any litigation arising out of your use of or inquiries to the Website will be an appropriate federal or state courts in Anoka County, Minnesota.  You agree to the exercise of personal jurisdiction in these courts related to any disputes you have with MNFI or any of the Parties.  

Changes to the Terms of Use

We may update the Terms at any time, and such updated versions will be posted on the Sites.   Your use of the Sites after the Terms are posted is your consent to any such updated version of the Terms.  If you do not want to agree to these Terms or any updated versions of the Terms, you must not access or use the Sites.  You are encouraged to check this page frequently, so you are aware of any changes, as they are binding on you.  The Terms govern all donations, grant requests and other actions conducted by you through the Sites.

My Account Content

To access the Sites or some of the content they offer, you will be required to create an account and register with us.  You will be asked to provide certain registration details or information.   You are required to provide us correct, current and complete information.  You consent to our use and actions related to that information and any other information you provide to us consistent with our Privacy Policy.

If you choose or are provided a username and password, or any other information related to our security policy and procedures, you agree to treat such information as confidential.  You cannot disclose it to any other person or entity.   You also agree that this also applies to any information, tools, documents or other materials that are only accessible by creating and account and use of the username and password. You should be careful and cautious when accessing your account using a public or shared computer where others can view or otherwise record and capture your personal information. MNFI retains the right to disable any username, password or any other items related to your account, at any time and within our sole discretion for no reason or any reason, including if, we believe, reasonably or not, you have violated the Terms.
